New Delhi. 03 August 2019. We got independence on 15th August 1947 and in the God ’s year of 2019 i.e. 72 years later are we really independent? We go to the streets and find chaos every where ; unruly , unemployed and under nourished roam in large numbers. Blame game is population and education ; then why didn’t we control the population and made education compulsory, useful and moved ahead. Japan was devastated in 1945 by the invasion of US when they dropped Atom Bomb on Nagasaki and Hiroshima and enslaved them. Today Japan is a power to reckon with , self reliant , technologically advanced and financially robust. When one analyses their graph of defeat to success the major factor which stands out is their nationalism. Have we got an iota of that –ne !
India has three pillars of democracy ; the legislature ,the Executive and the Judiciary . Normally Media or Press is termed as the forth pillar. Powers among these three are completely separated yet they are closely interlinked to each other. The Legislature makes laws which regulates our country. The Judiciary imparts justice in cases related to civil and criminal acts. The Executive implements these laws and deals with day-to-day administration. The Executive is held responsible via the Parliamentary procedures. Thus , this system makes way for an effective means of curbing the concentration of power in any one arm of the democracy. The unsung heroes of Media act as a watch dogs and exposes the discrepancies in the government and represent the mind and thinking of the public. We have not been able to mature any of them to a world order . The caste , creed , class have brought us to knots. Legislature can be manipulated by numbers, Executive branch is most gullible & suffers from corruption and judiciary can be purchased to an extent that the rogues who are influential move with freedom & the innocents languish in the jails. This cancerous ailment has brought criminals to legislate us , corrupt executives amass large wealth and the judiciary does not want to lag behind in the game of loot.
With such inefficient and inapt pillars of democracy our various institutions suffer. After independence various Princely States were brought under the republic . However, the State of Kashmir got a special status by the enactment of Articles 35 A which allows the Jammu and Kashmir legislature to define permanent residents of the state. It was inserted through the Constitution Application to Jammu and Kashmir , on the advice of the Nehru-led Union Government Order, 1954, which was issued by President Rajendra Prasad under Article 370 of the Indian constitution which is an article that gives autonomous status to the state of Jammu and Kashmir.
The article is drafted in Part XXI of the Constitution: Temporary, Transitional and Special Provisions. The Constituent Assembly of Jammu and Kashmir, after its establishment, was empowered to recommend the articles of the Indian constitution that should be applied to the state or to abrogate the Article 370 altogether. After the J&K Constituent Assembly later created the state’s constitution and dissolved itself without recommending the abrogation of Article 370, the article was deemed to have become a permanent feature of the Indian Constitution.
Over the years J &K got special treatment and subsidies from the Govt of India. However , J &K has been a bone of contention between India & Pakistan. After Pakistan was defeated and divided by India in 1971 ,Pakistan resorted to psychological warfare in the form of counter insurgency operations. People of Kashmir who were majorly Muslims were lured to create unrest to an extent that the Hindu population was forced to leave the state .Today they live as migrants not only in India but even abroad. It has now been 30 years and we have not been able to resettle these Hindus back in Kashmir. Can there be a greater example of the callousness, antipathy & insensitivity on the part of our so called pillars of democracy ?
BJP , the ruling party – in its election manifesto had stated to resolve this problem by abrogating Article 35 A. Amit Shah , the Home Minister is a man of action and a Chanakya incarnate. The Chess board is set and the environment is in favor –as most of the leaders of J &K have been exposed for their links and funding by Pakistan. This is the time to bestow justice to the migrant Hindus of J & K. NOW or NEVER .
